1. Definitions

  1. The "Portal" is the website accessible under the domains operated by the Service Provider (including relaxtallinn.ee, relaxtartu.ee and relaxpärnu.ee).
  2. The "Service Provider" is the owner and editorial team of the Portal, represented by the contact published in the Portal footer.
  3. The "Service" is the addition, browsing, searching and answering of listings on the Portal, together with any other features offered through the Portal (including promotion and validity extension via SMS payment).
  4. A "User" is any natural person who accesses the Portal or uses the Service in any way.
  5. A "Listing" is a personal dating advertisement added to the Portal by a User, together with its associated photos, contact details and other content.
  6. "Content" is any information (text, photos, contacts and similar) added to or transmitted via the Portal by a User.

2. Conditions for using the Service

  1. The Portal is intended exclusively for persons at least 18 years of age. By using the Service the User confirms his or her age and is liable for the correctness of that confirmation.
  2. The User uses the Service at his or her own responsibility and risk.
  3. The Service Provider does not guarantee that use of the Service is safe, beneficial or satisfactory to the User.
  4. The Service Provider does not guarantee uninterrupted, error-free or timely provision of the Service nor the preservation of any data entered by the User.
  5. Personal data is processed in accordance with the Privacy Policy and applicable data-protection law (including Regulation (EU) 2016/679 and the Estonian Personal Data Protection Act). Nothing in these terms releases the Service Provider from its statutory obligations.
  6. The Service Provider does not guarantee the User's complete anonymity or preservation of privacy beyond the obligations that follow from law or the Privacy Policy (the User discloses his or her own data in the Listing, replies see the contact provided, etc.).
  7. Browsing listings is free of charge. Posting a Listing at /post-listing is also free; only optional add-on features (such as promotion or validity extension) are paid, and their prices and conditions are published in the corresponding instructions and payment views.
  8. The Service Provider does not verify the truthfulness, accuracy or timeliness of information published in Listings or sent by e-mail.

3. Content requirements

  1. A Listing may only be a personal dating advertisement; it may not be a commercial advertisement, a solicitation or facilitation of prostitution, an offer of escort services or any other unlawful offer of services.
  2. The text, photos and other content of a Listing must not violate the laws of the Republic of Estonia or generally accepted morality. In particular, content is prohibited that:
    • depicts minors in a sexual manner, in the nude or otherwise referring to sexual activity;
    • incites violence, hatred, terror or discrimination;
    • infringes the rights of third parties (including copyright, personality rights, trademark rights or the right to one's image);
    • contains malware, phishing links, spam or other harmful or misleading material.
  3. The User warrants that he or she holds all rights necessary for the Content of the Listing (including the consent of any person depicted in photos to their publication on the Portal) and is fully responsible for all Content posted by him or her.
  4. By submitting a Listing the User grants the Service Provider a free, perpetual, worldwide, sub-licensable, non-exclusive licence to display, copy, store, adapt (including for technical purposes such as thumbnails and format conversion) and distribute the Content within the scope of providing the Service, including for marketing and archiving purposes.

4. Rights of the Service Provider

  1. The Service Provider has the right to refuse to provide the Service to a User without giving reasons.
  2. The Service Provider has the right to suspend or fully terminate the provision of the Service to a User without prior notice.
  3. The Service Provider reserves the absolute right to remove, modify, hide, suspend or re-publish any Listing, advertisement or other User content without prior notice and without any obligation to refund. This right applies to all materials published on the Portal regardless of whether the reason for removal is a breach of these terms, a third-party complaint, a technical fault, commercial considerations or otherwise.
  4. A Listing remains on the Portal for an indefinite period or until the User removes it or the Service Provider removes or modifies it under section 4.3.
  5. The Service Provider may unilaterally amend these terms. Amendments take effect upon publication on the Portal. Continued use of the Service after publication of the amendments constitutes the User's acceptance of the amended terms.

5. Limitation of liability

  1. The Service Provider is not liable for any direct or indirect damages or lost profit arising from the use or inability to use the Service.
  2. The Service Provider is not liable for breaches of these terms committed by Users, regardless of the size or form of the damage caused.
  3. The Service Provider is not liable for the truthfulness of any information (including Listings, contact details and comments) made available through the Service or for damages caused by such information.
  4. The Service Provider is not liable for the content, quality or lawfulness of destinations linked to from the Portal.
  5. The Service Provider is not liable for the acts or omissions of third parties (including other Users, telecommunications operators, payment service providers, hosting and CDN providers).
  6. The Service Provider is not liable for damages caused by technical faults, maintenance, cyber-attacks, force majeure or other circumstances beyond the Service Provider's control.
  7. The Service Provider is not liable for the consequences of misunderstanding any phrase, word or concept used in these terms. In case of interpretive differences, the Estonian-language text prevails.
  8. To the extent permitted by law, the Service Provider's total liability to a User per incident is limited to the service fees actually paid by that User over the preceding 12 months (€0 for free services).

6. Processing of personal data

  1. The Service Provider is the controller of personal data. The purposes, legal bases, retention periods and the data subject's rights (including access, rectification, erasure and objection) are described in the Privacy Policy.
  2. The User undertakes not to include in any Listing the personal data of third parties (including their photos) without those persons' prior, explicit consent.

7. Intellectual property

  1. The Portal's design, trademark, source code, database and other content created by the Service Provider are the intellectual property of the Service Provider and are protected by Estonian and international law. Their use without the Service Provider's written permission is prohibited.
  2. Copyright in User-submitted Content remains with the User, subject to the licence granted in section 3.4.

8. Applicable law and resolution of disputes

  1. These terms and the relationships arising from the use of the Service are governed by the laws of the Republic of Estonia, irrespective of conflict-of-laws rules.
  2. The parties shall endeavour to resolve disputes through negotiation. Failing agreement, disputes shall be resolved by Harju County Court (Tallinn courthouse). Consumers additionally have the right to address the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (komisjon.ee) or to use the European Commission's online dispute resolution platform (ec.europa.eu/consumers/odr).

9. Final provisions

  1. If any provision of these terms is or becomes invalid or unenforceable, the validity of the remaining provisions is not affected.
  2. These terms constitute the entire agreement between the User and the Service Provider regarding the use of the Service and supersede any prior agreements on the same subject.
  3. The User may contact the Service Provider regarding these terms, Listings and the Service through the contact published in the Portal footer.
